Mr Smooth Ice Cream Trucks — Terms & Conditions

Services Provided

Mr Smooth provides mobile ice cream truck service for private and public events, including birthdays, corporate events, schools, churches, HOAs, community events, festivals, and private parties.

Booking & Reservation

Submitting a request or receiving an estimate does not confirm the booking. All events require review and approval by Mr Smooth. The event date is not locked until deposit/payment is received.

Pricing

Pricing depends on guest count, selected menu, service hours, event type, and location. Pricing is based on the confirmed guest count. Final guest count is due 7 days before the event.

Payment

A 50% deposit is required for most bookings after availability is approved. The remaining balance is due 7 days before the event. Events booked within 7 days require full payment upfront. Far events, weekend events, holiday events, large events, or custom quotes may require full payment upfront.

Accepted payments: Cash, card, Cash App, Venmo, Zelle, ACH, and corporate check. Personal checks are not accepted.

Guest Count & Overages

Customer is responsible for providing an accurate guest count. If more guests are served than the approved guest count, overage charges may apply.

• Standard Menu overage: $5 per additional guest.
• Full Menu overage: $7 per additional guest.
• Ticket events: overage is based on selected ticket level.

Additional Service Time

Additional time may be available if the truck schedule allows. Additional time must be approved and paid for.

Travel Fees

The first 10 miles are free. After 10 miles, a travel fee of $0.75 per mile applies. Travel fee shown during booking is an estimate based on ZIP-to-ZIP distance. Final travel fee is confirmed after Mr Smooth reviews the event location. Far locations may require manual review.

Guest-Paid Events

Guest-paid vending is best for HOAs, pools, apartments, festivals, schools, business parks, and public community events. Private house guest-paid events are only available in Howard County or nearby areas and may require a minimum sales guarantee. Private house guest-paid events outside Howard County require host-paid pricing, a minimum sales guarantee, or manual approval.

Setup, Access & Customer Responsibilities

Customer must provide safe and clear access for the truck, enough space for setup, and a legal setup location. Customer is responsible for confirming that food trucks are allowed at the event location. Any required property approval, HOA approval, school approval, permit, or site permission must be arranged by the customer unless otherwise agreed.

Delays

Delays caused by wrong address, blocked access, unsafe setup, restricted access, or site limitations may reduce service time and are not eligible for refund.

Weather

Weather is not guaranteed. Rain dates are not guaranteed and must be approved based on truck availability. Mr Smooth may decide whether service can proceed if conditions are unsafe.

Cancellation

Deposits are non-refundable once the date is confirmed. Weekend and holiday payments may be non-refundable. Cancellations within 7 days of the event are non-refundable.

Rescheduling

One reschedule may be allowed with at least 7 days’ notice, based on availability. Rescheduled events must be approved by Mr Smooth. Rescheduling within 7 days of the event is not guaranteed.

Allergies

Customer is responsible for informing Mr Smooth of any allergies before the event. Mr Smooth cannot guarantee an allergen-free environment.

Damage & Liability

Customer is responsible for damage caused by guests to Mr Smooth equipment or vehicles. Mr Smooth is not responsible for lost items.

Photo / Marketing

Mr Smooth may take photos or videos during events for marketing unless the customer requests otherwise before the event.

Acceptance

By approving the estimate, submitting payment, or confirming the booking, the customer agrees to these terms.
